1. Introduction

Welcome to TrioByte Corp. ("TrioByte," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our marketplace platform (triobyte.tech), where users can buy and sell PC components, tech products, request custom PC builds, and access technical services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. Services Offered

2.1 Marketplace Services

  • Search & Browse - Discover products by category, price, and specifications
  • Secure Transactions - Payment processing and order management

2.2 Custom PC Building

  • PC Build Requests - Submit custom build requirements and get professional quotes
  • Component Selection - Expert recommendations for gaming, workstation, or streaming setups
  • Professional Assembly - Certified technicians build and test your PC
  • Warranty & Support - Post-build technical support and warranty coverage

2.3 Technical Services

  • PC Repairs - Diagnosis and repair of hardware and software issues
  • Hardware Upgrades - RAM, storage, GPU, and other component installations
  • Software Installation - OS installation, drivers, and software setup
  • Technical Support - Expert consultation and troubleshooting

2.4 Platform Features

  • Service Requests - Easy submission through Projects page for repairs and services
  • Tech News Feed - Latest technology news and updates
  • Community Features - User profiles, reviews, and seller ratings

3. Account Registration

3.1 Eligibility

You must be at least 18 years of age to create an account and use our Services. By creating an account, you represent and warrant that you meet this age requirement.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breaches

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Payment Terms

4.1 Marketplace Pricing

Pricing structure:

  • Product Listings: Sellers set their own prices for items
  • Custom PC Builds: Quotes provided based on selected components and assembly service
  • Technical Services: Pricing based on service type and complexity
  • Platform Fees: No listing fees; transaction fees may apply (details provided at checkout)

4.2 Accepted Payment Methods

  • Cash on Delivery (COD): Pay with cash when you receive your order
  • Whish Money: Transfer payment to Whish number 71227383 (include order reference in note)
  • Currency: Prices displayed in USD or LBP based on seller preference

4.3 Payment Schedule

For marketplace purchases:

  • Cash on Delivery: Payment due upon receiving the product
  • Whish Money: Transfer before shipping; order processed after payment confirmation

For custom PC builds:

  • 50% upfront deposit required to order components
  • 50% final payment due upon assembly completion and delivery (COD or Whish Money)

4.4 Refund Policy

  • If a project is more than 5% complete, no refunds will be issued
  • Refunds for projects less than 5% complete will be processed within 14 business days, minus any documented work completed
  • The determination of project completion percentage is based on agreed milestones documented in the project proposal
  • PC build component orders are non-refundable once components have been ordered from suppliers

4.5 Cancellation Policy

  • Clients may cancel a project before 5% completion with a refund of the deposit minus documented work completed
  • Cancellations after 5% completion are non-refundable; client receives all work completed up to cancellation date
  • TrioByte reserves the right to cancel any project with full refund if we determine we cannot meet the project requirements
  • 48 hours notice required for cancellation to avoid processing fees

5. Project Delivery & Warranty

5.1 Project Timeline

Project timelines are estimated at the time of agreement and documented in the project proposal. TrioByte strives to meet all deadlines but cannot guarantee specific delivery dates due to:

  • Scope changes requested by the client
  • Infrastructure limitations (power outages, internet connectivity issues common in Lebanon)
  • Client delays in providing required materials, content, or approvals
  • Force majeure events (detailed in Section 13)

5.2 Rush Work Services

TrioByte offers expedited rush work services for clients with urgent needs:

  • Rush work incurs additional fees (typically 30-50% surcharge depending on urgency)
  • Subject to availability and current workload
  • Minimum 48-hour turnaround for rush requests
  • Priority support and dedicated resources allocated

5.3 Warranty Period

All development work includes a 1-year warranty from delivery date covering:

  • Critical bugs and functionality issues in our delivered code
  • Security vulnerabilities in code written by TrioByte
  • Performance optimization for specifications agreed in project scope
  • Free bug fixes and critical patches

Warranty Exclusions:

  • Issues caused by client modifications to delivered code
  • Third-party service failures (hosting providers, payment gateways, etc.)
  • Hosting/server issues not directly managed by TrioByte
  • Issues arising from outdated dependencies after 6 months (security updates provided separately)
  • Feature requests or scope changes beyond original agreement
  • Compatibility issues with new browser/OS versions released after delivery

5.4 PC Build Warranty

  • Hardware Warranty: Individual components carry manufacturer warranties (typically 1-3 years)
  • Assembly Warranty: 1-year warranty on assembly workmanship and compatibility
  • Post-Build Support: Free technical support for 30 days after delivery

6. Liability & Indemnification

6.1 Service Commitment

TrioByte commits to delivering:

  • Fast, reliable, and high-quality work
  • Competitive pricing with quality service
  • Responsive communication throughout projects
  • Rush work capability for urgent client needs

6.2 Limitation of Liability

In the event of critical service failures or downtime caused by TrioByte's negligence:

  • TrioByte will work immediately to resolve the issue at no additional cost
  • If the issue causes measurable financial loss to the client, TrioByte will compensate for documented losses on a case-by-case basis

Compensation amount will be determined based on:

  • Severity and duration of the issue
  • Documented financial impact to the client
  • TrioByte's responsibility vs. third-party service failures
  • Good faith negotiation between parties

Maximum Liability:

  • TrioByte's maximum liability for any claim shall not exceed the total amount paid by the client for the specific service in question
  • TrioByte is not liable for indirect, incidental, special, consequential, or punitive damages
  • TrioByte is not liable for loss of profits, revenue, data, or business opportunities

6.3 Client Responsibility

The client agrees to:

  • Provide accurate project requirements and timely feedback
  • Test delivered work within agreed testing periods
  • Report issues immediately upon discovery
  • Maintain backups of critical data
  • Not hold TrioByte liable for issues outside our direct control

6.4 Indemnification

You agree to indemnify and hold harmless TrioByte, its officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you provide or upload to our platform

7. Intellectual Property Rights

7.1 Client Ownership

Upon full payment completion:

  • Client owns all rights to custom code, designs, and deliverables created specifically for their project
  • TrioByte transfers complete ownership, including source code, design files, and documentation
  • Client may modify, distribute, or commercialize the delivered work without restriction

7.2 TrioByte Portfolio Rights

TrioByte retains the right to:

  • Display completed projects in our portfolio (with client permission)
  • Use project case studies for marketing purposes (anonymized if requested)
  • Reference client relationships in proposals (with client permission)

7.3 Open-Source Components

Our development work incorporates industry-standard open-source libraries and frameworks, including but not limited to:

  • Frontend: React, Next.js, TypeScript, Tailwind CSS
  • Backend: Node.js, Supabase, PostgreSQL
  • Authentication: Supabase Auth, OAuth providers
  • Tools: Various npm packages and development tools

These open-source components:

  • Remain under their respective licenses (MIT, Apache 2.0, etc.)
  • Are documented in project delivery packages
  • Do not limit client ownership of custom code built on top of them

7.4 Pre-Existing TrioByte IP

TrioByte retains ownership of:

  • Internal tools, frameworks, and methodologies developed prior to client engagement
  • Reusable code modules and libraries created by TrioByte
  • TrioByte branding, trademarks, and proprietary processes

7.5 Third-Party Licenses

Clients are responsible for obtaining licenses for:

  • Stock photos, fonts, or media not provided by TrioByte
  • Third-party APIs or services integrated into their project
  • Premium plugins or extensions requested by client

8. Data Privacy & Security

8.1 Data Storage

  • User data is stored on Supabase secured servers hosted on AWS (ap-south-1 region - Mumbai, India)
  • All data transmissions are encrypted using industry-standard SSL/TLS protocols
  • Database access is restricted and secured with row-level security policies

8.2 Data Collection

We collect and process:

  • Account Information: Email, full name, profile data
  • Usage Data: Platform activity, feature usage, project information
  • Technical Data: IP addresses, browser information, device data
  • Project Data: Client project files, communications, deliverables

8.3 Data Usage

Your data is used solely for:

  • Providing and improving our Services
  • Project management and communication
  • Platform functionality and user experience
  • Security and fraud prevention
  • Legal compliance

8.4 Data Sharing

TrioByte never shares, sells, or distributes user data to third parties except:

  • When required by law or legal process
  • With client explicit consent for specific purposes
  • To protect TrioByte's legal rights
  • To prevent fraud or security threats

8.5 Data Retention

  • Active account data is retained indefinitely while account is active
  • Project data is retained for 3 years after project completion for warranty support
  • Upon account deletion, personal data is permanently deleted within 30 days
  • Backup copies are deleted within 90 days

8.6 User Rights

You have the right to:

  • Access your personal data
  • Correct inaccurate data
  • Request data deletion
  • Export your data
  • Opt-out of marketing communications

9. User Conduct

9.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Harass, abuse, or harm other users
  • Impersonate any person or entity
  • Spam or send unsolicited communications
  • Scrape or data mine our platform
  • Use automated bots without permission

9.2 Content Standards

Any content you upload or share must:

  • Be accurate and not misleading
  • Not contain offensive, harmful, or illegal material
  • Not violate any third-party rights
  • Comply with Lebanese laws and international standards

9.3 Enforcement

TrioByte reserves the right to:

  • Remove any content that violates these Terms
  • Suspend or terminate accounts for violations
  • Report illegal activities to authorities
  • Take legal action against violators

10. Dispute Resolution

10.1 Informal Resolution

In the event of any dispute, claim, or controversy:

  • First Step: Contact team@triobyte.tech to attempt friendly resolution
  • Good Faith Negotiation: Both parties agree to negotiate in good faith for 30 days
  • Documentation: All disputes should be documented in writing with clear description of the issue

10.2 Mediation

If informal resolution fails:

  • Parties agree to attempt mediation before pursuing legal action
  • Mediation costs split equally between parties
  • Mediation to be conducted in Beirut, Lebanon

10.3 Legal Jurisdiction

If mediation fails, disputes shall be resolved through:

  • Governing Law: Lebanese law governs these Terms
  • Jurisdiction: Courts of Beirut, Lebanon have exclusive jurisdiction
  • Language: Proceedings conducted in Arabic or English as agreed by parties

10.4 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

11. Intellectual Property Claims

11.1 Copyright Infringement

If you believe content on our platform infringes your copyright:

Send written notice to team@triobyte.tech with:

  • Description of copyrighted work
  • Location of infringing content
  • Your contact information
  • Good faith statement of infringement
  • Statement of accuracy under penalty of perjury
  • Physical or electronic signature

11.2 Counter-Notice

If your content is removed for alleged infringement, you may submit a counter-notice with similar documentation proving your right to use the content.

12. Platform Modifications & Availability

12.1 Service Changes

TrioByte reserves the right to:

  • Modify, suspend, or discontinue any part of our Services
  • Update pricing with 30 days notice
  • Change features or functionality
  • Update these Terms (with notice to users)

12.2 Service Availability

  • We strive for 99% uptime but cannot guarantee uninterrupted service
  • Scheduled maintenance will be announced 48 hours in advance when possible
  • No compensation for downtime due to circumstances beyond our control

12.3 Infrastructure Challenges

Due to Lebanon's current situation:

  • Power outages may cause temporary service interruptions
  • Internet connectivity issues may affect response times
  • Mobile operations may result in occasional unavailability
  • All efforts made to minimize disruptions

13. Force Majeure

TrioByte shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters (earthquakes, floods, fires)
  • War, terrorism, civil unrest, or military operations
  • Government actions, regulations, or restrictions
  • Power outages or telecommunications failures
  • Internet service disruptions
  • Political instability in Lebanon or the region
  • Displacement due to security situations
  • Pandemics or public health emergencies
  • Acts of God

In force majeure events:

  • TrioByte will notify clients as soon as reasonably possible
  • Project timelines will be extended by the duration of the event
  • No penalties or liquidated damages will apply
  • Both parties agree to work cooperatively toward resolution

14. Termination

14.1 Termination by User

You may terminate your account at any time by:

  • Contacting team@triobyte.tech
  • Following account deletion procedures in your profile settings
  • Providing 7 days written notice for active projects

14.2 Termination by TrioByte

We may terminate or suspend your account immediately if:

  • You violate these Terms
  • You engage in fraudulent activity
  • You abuse or harass our staff or other users
  • Required by law or legal authorities
  • Account has been inactive for 2+ years

14.3 Effects of Termination

Upon termination:

  • Your right to use the Services ceases immediately
  • Outstanding payments become due immediately
  • You may request data export within 30 days
  • TrioByte may delete your data per retention policy
  • Sections 6, 7, 8, 10, and 15 survive termination

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and TrioByte regarding use of our Services and supersede all prior agreements.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

15.3 Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

15.4 Assignment

You may not assign these Terms without our written consent. TrioByte may assign these Terms without notice.

15.6 Language

These Terms are provided in English. In case of translation, the English version prevails.

15.7 Independent Contractors
